Terms of Service – Events, Photography & Videography
1. Scope of Services
Brey Fuentes Films provides professional photography and videography services, including (but not limited to) pre-production planning, on-site coverage, post-production editing, and final delivery of agreed media assets.
The specific scope, inclusions, deliverables, timelines, and usage rights for each project will be outlined in a written proposal, invoice, or service agreement. Any services not expressly included may incur additional fees.
2. Booking & Payment Structure
• A 50% non-refundable retainer fee is required to secure the booking date.
• No services will commence until the deposit has been received and confirmed.
• The remaining 75% balance is due upon project delivery, unless otherwise agreed in writing.
• Payments may be made via bank transfer, credit card, or other agreed methods.
• Invoices unpaid 14 days after issue may incur a late fee of 5% per week until paid in full.
3. Revisions & Edits
• The agreed service package includes up to two (2) rounds of revisions.
• Revision requests must be submitted within seven (7) days of receiving the draft.
• Additional revisions beyond the included rounds are charged at $110 per hour, billed in 30-minute increments.
• Revision requests must align with the original creative direction and brief. Requests that constitute a change in scope may be quoted separately.
4. Intellectual Property & Usage Rights
• All RAW files, unedited footage, and project files remain the property of Brey Fuentes Films, unless otherwise agreed in writing.
• Final delivered content is licensed to the Client for social media and social media advertising use only, unless expanded usage rights are agreed upon in writing.
• Brey Fuentes Films retains the right to display completed work for portfolio, website, social media, and marketing purposes, unless written restrictions are provided prior to the project.
5. Cancellations & Rescheduling
Cancellations
• More than 14 days prior to the shoot: all payments refunded excluding the non-refundable deposit.
• 3–14 days prior to the shoot: 50% cancellation fee applies.
• Less than 3 days prior to the shoot: 75% cancellation fee applies.
Rescheduling
• Rescheduling is subject to availability.
• Additional costs may apply if changes result in extra expenses, crew rebooking, or revised deliverables.
6. Client Responsibilities
• The Client must provide all required materials (e.g. branding assets, logos, scripts, shot lists, timelines) before production begins.
• Delays caused by missing or late materials may result in extended timelines or additional charges.
• The Client is responsible for obtaining all required permissions, location access, and talent releases prior to filming.
7. Project Turnaround Time
• Estimated turnaround times will be communicated prior to or at the commencement of the project.
• Turnaround times may vary depending on project complexity and workload.
• Rush or expedited delivery may be available for an additional fee, subject to availability.
8. Limitation of Liability
Brey Fuentes Films will take all reasonable steps to ensure professional delivery of services. However, we are not liable for delays, interruptions, or failures caused by circumstances beyond our control, including but not limited to weather conditions, venue restrictions, technical issues, or client-related delays.
In the unlikely event that Brey Fuentes Films is unable to deliver the agreed services, liability is limited to a refund of payments received.
9. Confidentiality & Privacy
All client-provided materials and project details will be treated as confidential unless permission is granted for promotional or portfolio use.
10. Crew Welfare, Breaks & Meals
Breaks
For bookings where crew are engaged for five (5) hours or more, reasonable rest and/or meal breaks will be scheduled in accordance with workplace health and safety obligations.
Meal Entitlement
For bookings of five (5) hours or more, crew are entitled to a meal break. Unless otherwise agreed in writing, this may be satisfied by one of the following, at Brey Fuentes Films’ discretion:
• A meal provided by the Client or venue
• Reasonable access to on-site catering
• Sufficient time to obtain food off-site
• A meal allowance charged to the Client at a reasonable rate
Client Acknowledgement
The Client acknowledges that crew welfare, including breaks and meal arrangements, is managed solely by Brey Fuentes Films and is not subject to restriction by the Client or venue, provided agreed deliverables are not materially impacted.
11. Agreement & Acceptance
By engaging Brey Fuentes Films and confirming a booking, the Client acknowledges that they have read, understood, and agreed to these Terms of Service.
